Changes to 457 Occupations List February 2011

Some minor changes have been introduced to the list of occupations for the 457 business sponsorship program and come into effect today.

As a consequence of the new list being issued, a new legislative instrument for the minimum salary for English language exemption has been issued. However, the minimum salary for the exemption for English language testing remains at $85,090.

Occupations Excluded from 457 List

The following occupations have been excluded from the approved list of occupations for 457 visas:
ANZSCO Occupation Title
149999 Hospitality, Retail and Service Managers
442214 Private Investigator
451111 Beauty Therapist
552311 Bookmaker
552312 Insurance Consultant
599912 Production Assistant (Film, Television, Radio or Stage)
711912 Motion Picture Projectionist

Of these occupations the one which is most likely to have an impact is the Hospitality, Retail and Service Managers (nec) occupation. This was previously a useful "catch all" occupation for managers whose specific specialisation was not listed in the ANZSCO list of occupations.

Occupations where Specific Exclusions have been Added

DIAC has clarified that the occupation of Cafe or Restaurant Manager (ANZSCO 141111) excludes positions in fast food or takeaway restaurants. This is likely to significantly affect student visa and working holiday visa holders seeking to move onto a 457 visa within such establishments.

The occupation of University Lecturer (ANZSCO 242111) has also been limited to Research Associates and Research Fellows only.

Occupations Added to the 457 List

The following occupations have been added to the 457 list:

These additions would appear to be occupations which have previously been excluded by error, or which have now been included due to pressure from special interest groups.
